This Agreement between sole proprietor Hukasyan Vidzhai Onikovych, hereinafter the Online Store, and the user of the online store's services, hereinafter the Customer, is a mandate agreement for the purchase and delivery of goods through the website https://edison.ua/
1.1. This agreement is a public offer agreement (pursuant to Articles 633 and 641 of the Civil Code of Ukraine); its terms are the same for all Customers regardless of status.
1.2. The Agreement is deemed concluded from the moment the Customer clicks the «Place order» button on the checkout page. By concluding this Agreement, the Customer fully accepts its terms.
2.1. The Online Store is an online shop hosted at https://edison.ua/, owned by sole proprietor Hukasyan Vidzhai Onikovych, located at 93 Klochkivska St., Kharkiv.
2.2. Goods – the list of products published on the online store's website according to the assortment sold by sole proprietor Hukasyan Vidzhai Onikovych.
2.3. Customer - an adult natural person or a legal entity / individual entrepreneur who, by using the online store's website, instructs the Online Store to purchase and deliver goods.
2.4. Order - the Buyer's request, registered and placed on the Online Store's website, instructing a courier or another third party independently designated by the Online Store without the Customer's approval, to purchase from sole proprietor Hukasyan Vidzhai Onikovych and to deliver, on behalf of and at the expense of the Customer, the purchased Goods.
2.5. Acceptance of the offer - the Customer's full and unconditional acceptance of the offer by placing an order on the Online Store's website.
2.6. Personal account - a space on the Online Store's Website accessible to the Customer that displays their personal information and the history of orders they have placed.
2.7. Website – the web page https://edison.ua/, owned by sole proprietor Hukasyan Vidzhai Onikovych, which displays the list of goods and their prices and through which the Customer may place an Order.
3.1. This agreement is a mandate agreement (pursuant to Article 1000 of the Civil Code of Ukraine) under which, upon selecting the Goods and ordering delivery of the purchased goods, the Customer instructs a courier or another third party independently designated by the Online Store without the Customer's approval to purchase from sole proprietor Hukasyan Vidzhai Onikovych the Goods selected by the Customer and deliver them to the address specified in the Order, and, if necessary, to accept funds from the Customer and pay them to the Online Store.
3.2. The price of the Goods is set and stated by the Online Store on the Website.
4.1. Customer registration on the Website is required to give the Customer access to personalized information and additional functionality for using the Website through the created Account.
4.2. Upon registration, the Customer provides the following data:
- full name;
- phone number;
- email address;
- password.
4.3. The Customer undertakes to provide relevant, accurate and complete information about themselves.
4.4. After registering on the Website, the Customer is granted access to the Personal account.
4.5. The Customer undertakes not to disclose their registration details to third parties and is responsible for the confidentiality of the password and for any actions on the Website performed under their name and account.
4.6. The Online Store has the right to refuse the Customer the use of its services if it has grounds to believe that the Customer has provided inaccurate data, as well as in the event of bad-faith conduct (for example, violation of the terms of this agreement, etc.).
4.7. Use of the Website for illegal activities or activities prohibited by law is forbidden.
4.8. In addition to the data provided in section 4.2 of this Agreement, the Online Store receives from the Customer:
- delivery address information
- information about the Customer's tastes, interests and preferences
- and other information.
4.9. By providing personal data on the Website during registration or when placing an Order, the Customer gives voluntary consent to the processing and use (including transfer) of their personal data for an unlimited term of such consent in accordance with the applicable legislation of Ukraine.
4.10. The Online Store uses the personal data received from the Customer under this Agreement to promote the services it provides, including through automated processing of personal data. The Online Store undertakes not to disclose the information received from the Customer.
4.11. If the Customer no longer wishes the Online Store to process their personal data, they must contact the support service.
4.12. By registering on the Website or placing an Order without registration, the Customer consents to receiving informational messages from the Online Store and its partners via the Short Message Service (SMS) and email.
4.13. At any time, the Customer may opt out of such mailings by changing the relevant settings in the Personal account on the Website.
5.1. The Customer places the order on the Website independently by adding the selected Goods and the delivery address to the virtual cart and clicking the «Order» button.
5.2. All Customers, whether registered or not, may place an Order for Goods in the Online Store.
5.3. Delivery of Goods by the Online Store is available from 10:00 to 21:00 Monday through Friday and from 10:00 to 18:00 on Saturdays.
5.4. The Goods are paid for by the Buyer on a prepayment basis at the time of placing the order online via the Portmone.com service, or by reimbursing, in cash, the courier or another third party independently designated by the Online Store and performing the mandate under this Agreement for their expenses in purchasing the Goods in performance of the mandate under this Agreement, at the moment the Order is delivered to the address specified by the Customer, after the Customer has inspected and checked the Goods ordered and delivered to the specified place of delivery.
5.5. The mandate is performed under this Agreement by a courier or another third party independently designated by the Online Store and performing the mandate under this Agreement without any remuneration, whereby the Customer is obliged to pay for the Goods in full according to the Order or to reimburse the costs of purchasing the selected Goods according to the mandate.
5.6. The total cost of the Order, which includes the full price of the Goods and reimbursement of the actual expenses incurred in purchasing the Order, equals the amount that is paid and stated on the Website at the time of ordering and at the time of placing the Order.
5.7. Upon delivery of the Order, the Customer receives from the courier or another third party performing the mandate under this Agreement the following documents of the Online Store:
- a cash-register (RRO) receipt or a delivery note confirming the amount of expenses incurred by the courier or another third party performing the mandate under this Agreement in connection with fulfilling the Customer's Order (when Goods are delivered)
- a terminal receipt in the event of card payment for the Order, confirming the buyer's payment of the cost of the Goods and/or the Online Store's services.
5.8. When handing over to the Customer an Order that includes alcoholic products, a representative of the Online Store has the right to ask the Customer to present an identity document confirming compliance with the age restrictions established for Customers by this agreement.
5.9. The Customer should check the possibility of delivery outside Kyiv with the Online Store's operator.
5.10. The possibility of self-pickup should be checked with the Online Store's operator.
6.1. The Online Store performs the Customer's mandate to purchase and deliver the Order to the place and within the time interval specified by the Customer when placing the Order on the Website.
6.2. When placing an Order that includes alcoholic products, the Customer agrees that they may refuse only the entire list of ordered alcoholic products, and not part of it.
6.3. Alcoholic products of proper quality are non-returnable after payment in accordance with the requirements of the applicable legislation of Ukraine.
6.4. If defective Goods are discovered, the Customer has the right to demand from the Online Store:
- replacement with a similar product of proper quality;
- replacement with another product with a corresponding price recalculation;
- a refund
7.1. The Website contains trademarks and other legally protected materials, including but not limited to texts, photographs, graphic images, music and sound. All content of the Website is protected by the legislation of Ukraine.
7.2. The Customer may not use the materials posted on the Website other than to view them for the purpose of placing an Order; in particular, the Customer is not entitled (but not exclusively) to modify, publish, transfer to third parties, participate in the sale or concession of, or create derivative products from them, etc.
7.3. This Agreement is governed by the legislation of Ukraine.
7.4. The Online Store has the right to amend the text of this agreement at its own discretion at any time and without prior notice to Customers.
